The Indonesian version of these Terms of Service is the legally binding version. This English translation is provided for convenience.
1. Acceptance of Terms
By accessing or using services operated by Ashari Tech (“we”, “our”, or “us”), you agree to and are bound by these Terms of Service. If you do not agree to these terms, please do not use our services.
These Terms of Service apply to all websites, applications, platforms, and services operated by Ashari Tech, including AI services, automation, employee management, and custom client solutions.
2. Service Description
Ashari Tech provides technology and artificial intelligence (AI) solutions, including but not limited to:
- AI Services: AI assistants, chatbots, conversation automation, and intelligent data processing
- Automation Platform: Third-party service integrations, automated workflows, and webhooks
- Internal Management: Employee portal, attendance management, courses, assignments, and reporting
- Centralized Authentication: A centralized identity system that allows access to all services with a single account
- Custom Client Solutions: Applications and systems developed specifically for client business needs
These services may request access to your Google account data (Gmail, Calendar, Drive) to provide the requested functionality.
3. User Accounts
3.1 Registration
To use certain services, you must create an account. You may register using:
- Google OAuth: Sign in with your Google account (email is automatically verified)
- Email and password: Requires email verification before you can use the services
3.2 Account Responsibilities
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activity that occurs under your account
- Providing accurate and up-to-date information during registration
- Notifying us immediately of any unauthorized use of your account
3.3 Single Centralized Account
The account you create serves as a centralized identity for all Ashari Tech services. A single account can be used to access our various platforms and services without needing to re-register.
4. Google API Authorization
4.1 Scope of Access
When you connect your Google account through Ashari Cloud, you grant us permission to access the following specific scopes:
- gmail.readonly: Read-only access to your email messages and settings (we cannot send, modify, or delete emails)
- userinfo.email: Your Google account email address for identification
- userinfo.profile: Your display name and profile picture for the integration dashboard
- openid: Standard authentication scope for the OAuth 2.0 flow
We store OAuth tokens (encrypted with AES-256-GCM) to maintain your authorized session. Email content is fetched on-demand and not stored on our servers.
4.2 Authorization Management
You may:
- Revoke access at any time via Google Account Permissions
- Re-authorize if you revoke and wish to resume services
- Choose specific permissions during the authorization process
5. Acceptable Use
You agree to:
- Use our services lawfully and in accordance with these terms
- Not attempt to compromise the security of our systems
- Not abuse or misuse Google API integrations
- Comply with Google's Terms of Service and Acceptable Use Policy
- Provide accurate and non-misleading information
You agree NOT to:
- Use our services for spam, phishing, or malicious activities
- Attempt unauthorized access to other users' data
- Violate any applicable laws or regulations
- Reverse engineer or attempt to extract our source code
- Use bots, scrapers, or automated tools to access our services without permission
- Submit content that infringes on the intellectual property rights of others
- Use AI services to generate content that is illegal or harmful
6. AI Services
6.1 Nature of AI Services
Our AI services use artificial intelligence models that generate responses based on user input. AI-generated output is informational and should not be considered professional advice in legal, medical, financial, or other specialized fields.
6.2 AI Limitations
We do not guarantee that:
- AI responses are always accurate, complete, or up to date
- AI services will be available without interruption
- AI output is suitable for all situations or specific needs
7. Service Availability
7.1 Uptime
We strive to provide high-availability services, but we do not guarantee uninterrupted service availability.
7.2 Maintenance
We may perform scheduled maintenance with advance notice when possible.
7.3 Third-Party API Changes
Service functionality may change if Google or other third-party service providers modify or discontinue their API features.
8. Data and Privacy
8.2 Data Security
We implement industry-standard security measures, including:
- Encryption at rest (AES-256-GCM)
- Encryption in transit (TLS 1.3)
- Access control and multi-layered authentication
- Continuous security monitoring
8.3 Data Retention
We retain your authorization credentials and data while:
- You maintain an active account with us
- Our services require access to provide functionality
- Required by law or legitimate business purposes
9. Intellectual Property
9.1 Our Rights
All intellectual property in our applications, including source code, design, documentation, trademarks, and logos, belongs to Ashari Tech.
9.2 Your Rights
You retain all rights to your Google account data and content you create. Authorization does not transfer ownership of data.
9.3 User Content
By uploading or creating content through our services, you grant us a limited license to store, process, and display that content solely for the purpose of providing our services.
9.4 Client Projects
For custom client projects, intellectual property rights are defined in separate client agreements.
10. Limitation of Liability
To the maximum extent permitted by applicable law:
- We are not liable for indirect, incidental, or consequential damages
- Our total liability is limited to fees paid in the past 12 months
- We are not responsible for Google API service interruptions
- We are not liable for data loss due to user error or third-party service issues
- We are not liable for decisions made based on AI-generated responses
11. Indemnification
You agree to indemnify Ashari Tech against claims arising from:
- Your violation of these terms
- Your misuse of Google API integrations
- Your violation of third-party rights
- Your violation of applicable laws or regulations
- Content you create or upload through our services that infringes on the rights of others
12. Service Modifications
We reserve the right to:
- Modify or discontinue services with reasonable notice
- Change pricing for paid services with advance notification
- Update these terms (material changes will be notified via email or website notice)
13. Termination
13.1 By You
You may terminate your use of services by:
- Revoking your Google account access
- Closing your account by contacting us
- Requesting data deletion
13.2 By Us
We may suspend or terminate your access if:
- You violate these terms
- Your account is inactive for an extended period
- Required by law or Google policy
- We discontinue the service
13.3 Effect of Termination
Upon termination:
- Your Google authorization will be revoked
- Stored credentials will be deleted within 30 days
- Certain data may be retained as required by applicable law
14. Disclaimers
14.1 Service Quality
Services are provided “as is” without warranties of:
- Fitness for a particular purpose
- Non-infringement
- Error-free operation
- Continuous availability
14.2 Third-Party Services
We are not responsible for:
- Google API service quality or availability
- Third-party integrations or services
- Client data accuracy or completeness
15. Governing Law
These Terms of Service are governed by and construed in accordance with the laws of the Republic of Indonesia. Any disputes arising from or related to these terms shall first be resolved through deliberation and mutual agreement. If deliberation does not reach a resolution, disputes shall be settled through the competent courts in Indonesia.

If any provision of these Terms of Service is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
18. Entire Agreement
These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and Ashari Tech regarding the use of our services. For custom client projects, a separate service agreement (Master Service Agreement) may apply and shall prevail over these general terms where there is a conflict.
19. Language
These Terms of Service are written in Indonesian as the legally binding version. This English version is provided for reference and convenience only. In the event of any discrepancy between the Indonesian and English versions, the Indonesian version shall prevail.
21. Dispute Resolution
We are committed to resolving disputes fairly and efficiently through the following procedures:
Step 1: Informal Resolution
- Contact our support team at [email protected]
- We will attempt to resolve the dispute within 30 days
- Most disputes are resolved at this stage through good faith communication
Step 2: Mediation
If informal resolution fails, either party may request mediation:
- Mediation through recognized Indonesian alternative dispute resolution (ADR) bodies
- BANI (Badan Arbitrase Nasional Indonesia) or similar institutions
- Costs shared equally unless otherwise agreed
- Mediation conducted in Indonesian language
Step 3: Arbitration or Litigation
If mediation fails, disputes shall be resolved through:
- Jurisdiction: Courts of the Republic of Indonesia have exclusive jurisdiction
- Venue: Jakarta courts (or court with jurisdiction over our registered address)
- Arbitration Option: Parties may mutually agree to binding arbitration under Indonesian law
- Language: Legal proceedings conducted in Indonesian
⚠️ Note: Nothing in this section limits your right to file complaints with regulatory authorities (Ministry of Communication and Informatics) or seek consumer protection remedies under Indonesian law.
22. Force Majeure
We shall not be liable for failure to perform our obligations under these Terms if such failure results from circumstances beyond our reasonable control, including but not limited to:
- Natural disasters (earthquakes, floods, tsunamis, volcanic eruptions)
- Wars, terrorism, civil unrest, government actions
- Pandemics, epidemics, or public health emergencies
- Internet or telecommunications failures beyond our control
- Third-party service provider outages (AWS, Google, etc.)
- Cyberattacks, DDoS attacks, or hacking attempts
- Strikes, labor disputes, or other industrial actions
- Changes in laws or regulations that make service provision unlawful
📢 Notification: We will notify you as soon as reasonably practicable if a force majeure event prevents us from performing our obligations, and we will use reasonable efforts to minimize the impact of such events.
23. Assignment
Our Rights: We may assign, transfer, or delegate our rights and obligations under these Terms to:
- Any affiliate or subsidiary company
- An acquirer in the event of merger, acquisition, or sale of business
- Any successor entity to our business
Your Rights: You may not assign, transfer, or delegate your rights or obligations under these Terms without our prior written consent. Any attempted assignment without consent is void.
We will notify you of any assignment that materially affects your rights under these Terms.

Legal notices and communications shall be delivered as follows:

We may provide notices through:
- Email to the address associated with your account
- In-app notifications or banners
- Prominent notice on our website
- Physical mail to any address you have provided
Notices are deemed received: (1) immediately if by email or in-app notification during business hours, (2) next business day if sent outside business hours, (3) 3 business days if by mail.

25. Relationship of Parties
Nothing in these Terms creates any partnership, joint venture, agency, franchise, employment, or fiduciary relationship between you and Ashari Tech. You have no authority to bind Ashari Tech or make commitments on our behalf.

The following sections shall survive termination of these Terms:
- Intellectual Property (Section 9)
- Limitation of Liability (Section 10)
- Indemnification (Section 11)
- Disclaimers (Section 14)
- Governing Law (Section 15)
- Dispute Resolution (Section 21)
- Any provisions that by their nature should survive termination
27. Waiver
Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision. No waiver shall be effective unless made in writing and signed by an authorized representative of Ashari Tech. Any waiver of a breach shall not constitute a waiver of any subsequent breach.
28. Electronic Communications
By using our services, you consent to receive electronic communications from us. These communications may include:
- Service announcements and updates
- Security alerts and notifications
- Account-related communications
- Legal notices and policy updates
- Marketing communications (with your consent)
You agree that all agreements, notices, disclosures, and other communications that we provide electronically satisfy any legal requirement that such communications be in writing. You may withdraw consent to electronic communications by contacting us, but this may result in termination of your account.
29. Accessibility
We strive to make our services accessible to all users, including those with disabilities. We are committed to:
- Following Web Content Accessibility Guidelines (WCAG) where feasible
- Providing keyboard navigation support
- Ensuring screen reader compatibility
- Maintaining sufficient color contrast ratios
- Providing alt text for images
